Rosalinde Bakker is the artistic practice of visual artist Rosalinde Bakker, operating in the Netherlands. These Terms and Conditions apply to the use of this website and to all offers, agreements, and transactions relating to artworks, prints, commissions, and services provided by Rosalinde Bakker.
By accessing this website or purchasing any product or service, you agree to be bound by these Terms and Conditions.

2. Definitions

Customer: Any natural or legal person who enters into an agreement with the Artist

Artwork: Original works of art, editions, prints, installations, or commissioned works

Website: The official website and associated online platforms of Rosalinde Bakker
3. Applicability

These Terms and Conditions apply to all offers, quotations, agreements, deliveries, and services provided by Rosalinde Bakker Art, unless explicitly agreed otherwise in writing.
Any general terms and conditions used by the Customer are expressly rejected.
4. Offers and Agreements

All offers are non-binding unless stated otherwise.

An agreement is concluded once the Artist confirms an order in writing or electronically, or once payment has been received.

Rosalinde Bakker reserves the right to refuse orders without stating reasons.
5. Prices and Payment

All prices are stated in euros (€) unless indicated otherwise.

Prices include VAT where applicable, in accordance with Dutch tax law.

Payment must be made in full before delivery unless agreed otherwise in writing.

Accepted payment methods are listed on the website or invoice.

6. Delivery and Risk
​

Delivery times are indicative and not binding.

Artworks are carefully packaged and shipped via a professional carrier.

Risk of damage or loss transfers to the Customer at the moment of delivery.

International customers are responsible for any customs duties, taxes, or import fees.
7. Right of Withdrawal (Consumers in the EU)

In accordance with Dutch and EU consumer law:

Consumers have the right to withdraw from a purchase within 14 days of receiving the artwork, without stating reasons.

The right of withdrawal does not apply to:

Custom-made or commissioned artworks

Personalized works
-
Digital products once downloaded

Returned artworks must be unused, undamaged, and returned in original packaging.

Return shipping costs are borne by the Customer unless otherwise agreed.
8. Delivery and Risk

All artworks, images, texts, and designs remain the intellectual property of Rosalinde Bakker, unless explicitly agreed otherwise in writing.

Purchase of an artwork does not transfer copyright.

The Customer may not reproduce, distribute, publish, or commercially exploit the artwork without prior written consent from the Artist.

Rosalinde Bakker Art reserves the right to photograph and reproduce artworks for portfolio, publication, promotion, and archival purposes.

9. Commissions

Commissioned works are created in consultation with the Customer.

A deposit may be required before work begins.

Minor deviations in color, scale, or material are inherent to artistic practice and do not constitute defects.

Commissioned works are non-refundable unless otherwise agreed in writing.
10. Liability

Rosalinde Bakker Art is not liable for indirect or consequential damages, including loss of profit or business interruption.

Liability is limited to the amount paid by the Customer for the relevant artwork or service.

Nothing in these Terms limits liability in cases of intent or gross negligence.
11. Privacy and Data Protection
​
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch privacy laws.

12. Force Majeure
​
Rosalinde Bakker Art is not liable for delays or failures caused by circumstances beyond reasonable control, including but not limited to natural disasters, strikes, transport disruptions, or governmental measures.
13. Governing Law and Jurisdiction
​
All agreements are governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
